Policy and Regulation

RBIDZ is a state owned entity and has a responsibility to conduct procurement processes that are regulated by the relevant legislative framework.

The procurement process is bound and guided by various pieces of legislation including:

  • The Constitution of the Republic of South Africa, Act 108 of 1996, s217 (1) to 217 (3)

  • Public Finance Management Act 1 of 1999 (as amended by no 29 of 1999)

  • Framework in terms of the Public Finance Management Act, 1999: Framework for Supply Chain Management

  • Treasury Regulations for departments, constitutional institutions and public entities issued in March 2005 in terms of the PFMA

  • The Preferential Procurement Policy Framework No. 5 Act of 2000

  • Preferential Procurement Regulations of 2001

  • Broad Based Black Economic Empowerment Act, No 53 of 2003 and its associated Codes of Good Practise

  • National Treasury SCM guidelines  and practice notes
